- Definition
- The Contemporaneity Rule requires the Actus Reus and Mens Rea of a crime to occur at the same time. However, the courts have recognised that sometimes they need to allow flexibility in this area
- Continuing Act
- This applies if the Actus Reus comes before the Mens Rea. The Actus Reus is stretched over time to meet the point where the defendant has Mens Rea (Fagan v MPC (1969).
- One Transaction
- This applies if the Mens Rea comes before the Actus Reus. If the defendant's actions are part of the same series of events, the courts will recognise it as a single transaction. (Thabo Meli (1952 and Rv Church (1969).
