  • NECESSITY TEST
    • To find out and be certain of a person's name or address.
    • To prevent the person:
      • Causing physical injury to themselves and others.
      • Causing damage to property.
      • Committing public indecency.(e.g. Nudity)
      • Causing unlawful obstruction of the highway.
    • To protect a child or other vulnerable person.
    • To allow the prompt and effective investigation of the person.
    • So the person does not run away in order to hinder the prosecution.
    • Case: Richardson v Chief Constable of West Midlands (2011)
