- PACE CODE G Arrest
- Section 24 gives police the power to arrest
- Past offences: anyone they know or suspect has done an offence
- Present offences: know or suspect is in the process of committing an offence
- Future offences: know or suspect is about to commit an offence
- For a lawful arrest there are 2 elements under code G
- Actual, suspected or attempted involvement in a crime
- Reasonable grounds for believing that arrest is necessary
- Necessity test
- Ascertain the persons name or address
- protect a vulnerable child
- prevent injury to themselves or others
- prompt an investigation or conduct of a person

- Procedure
- 1) must be told they are being arrested, reason, why its necessary and the ID of police officer if not in uniform
- 2) Cautioned
- 3) Taken to the police station
- Once arrested the police have the power to search for anything which may help the suspect escape

- Bibby v Chief Constable of Essex police - breach of peace
- s1 Magistrates court act 1980 - court has issued a warrant for arrest
