Advantages

  • Case hardened - as full-time
  • As they have legal knowledge - they can get through cases much quicker

Disadvantages

  • Expensive - paid
  • Chosen from an educated part of society - Barristers and Solicitors - therefore not representative of the public

Evaluation

In the long run, Judges are better as they can get through cases quicker and are case hardened. Whereas Lay Magistrates cannot get through cases quickly. Though Magistrates are far cheaper and more representative of society.

Why is case hardened judges an advantage? I’ve been researching and all in sources point to a judge being case hardened as a bad thing. Due to the possibility of a judge become cynical and ignoring other contributing factors that lead to the crime being committed.

Can someone please offer advice on why being a case hardened judge is an advantage.

It gives them the ability to work under pressure and work through cases quickly due to their experience. This saves the courts time and money.
