Debates:

  • DETERMINISM vs. Freewill - Is the verdict a free choice? Are juries’ decisions a result of free will - maybe not since evidence shows they may be persuaded by a range of factors (expert witnesses etc.)
  • REDUCTIONISM vs. Holism - Generally, individual variables are separated from the overall courtroom experience and tested. (E.g. Pennington and Hastie isolated the IV of order of testimony to test its effect on number of guilty verdicts).
  • Ethnocentrism - Research based on UK/USA legal system, so not generalisable to cultures with different systems.
