Control by...PARLIAMENT

  • Negative Resolution - automatically becomes law unless an MP objects to it within 40 days. At this point, it will be immediately annulled.
  • Affirmative Resolution - will not become law unless specifically approved by Parliament.
  • Scrutiny Comittee - consider if statutory instruments are properly made.

Control by the...COURTS (JUDICIAL REVIEW)

A judge will check that the delegated legislation has been made
