Magistrate's to the Crown:

  • Avaliable to the defence
  • Can appeal against sentence and/or conviction
  • Heard by a single Circuit Judge and two magistrates
  • Possible to appeal to the Queen's Bench Division on a point of law
  • Possible further appeal to the Supreme Court
  • Appeal quashed, confirm appeal or remit case back to the Magistrates' Court

Magistrates' Court to the Queen's Bench Divisional Court:

  • Avaliable to the prosecution and defence
  • Appeal on a point of law by way of case stated
  • Panel of two or three High Court Judges, might include a Court of Appeal judge
  • Possible appeal by the prosecution or defence to the Supreme
