Statutory provisions (Implied by statute)
This means that if it is implied by statutes- regardless of the wishes of the parties or their knowledge of the terms.
Why??
1. In contrast to common law implied terms: the law is clearly willing to improve contracts & make them fairer.
2. “Paternalistic approach” this means that by Parliament is essential protection to consumers (e.g. protect the right to return the goods of unsatisfactory quality) due to
