LETTERS OF ADMINISTRATION WITH WILL ANNEXED
This would be the appropriate grant where either: -
· there is a will which does not expressly or impliedly appoint executors
· there is a will which does appoint an executor, but that executor has predeceased the testator
· there is a will which appoint executors, but those executors have declined to take out the grant (either renounced or been cited but have not taken out the grant )
· This will be the appropriate grant whether or not the will disposes of all or any of the deceased's property.
Rule 20 Non Contentious Probate Rules contains a list of those who are entitled to take out this grant. The list basically consists of those entitled to property under the will as it is thought appropriate…
